These terms govern your use of Agent88's AI executive assistant services. By engaging our services, you agree to these terms.
1. Services
Agent88 provides managed AI executive assistant services ("Services") including:
- Configuration, deployment, and ongoing management of AI executive assistants.
- Integration with your existing email, calendar, document, and communication tools as agreed during onboarding.
- Ongoing support, monitoring, and optimisation of your assistant.
Services are provided on a subscription basis as described in your service agreement.
2. Service tiers
Agent88 offers the following service tiers:
- Operator EA — for individual founders, partners, and senior operators.
- Practice EA — for firms with up to 5 users sharing an assistant.
- Enterprise — bespoke workflow modules scoped through consultation.
Tier details, pricing, and included features are specified in your service agreement and may be updated with notice.
3. Your responsibilities
You are responsible for:
- Providing accurate information during onboarding.
- Authorising access to the systems and data your assistant will use.
- Reviewing and approving actions flagged by your assistant before they are executed.
- Ensuring that your use of the Services complies with applicable laws and regulations, including Hong Kong's Personal Data (Privacy) Ordinance.
- Maintaining the security of your own systems and credentials.
4. Human approval and limitations
Your AI assistant operates on a draft-first basis by default. It prepares recommendations and drafts for your review — it does not take autonomous actions unless you explicitly configure it to do so.
Agent88 Services are not a substitute for professional advice. Specifically:
- Your assistant does not provide legal, medical, financial, or compliance advice.
- Output generated by your assistant should be reviewed before use.
- You are responsible for decisions made based on your assistant's output.
5. Data and privacy
Your data is governed by our Privacy Policy (available at agent88.hk/privacy).
In summary:
- Your business data is stored on your infrastructure, not ours.
- We do not use your data to train AI models.
- We do not share your data with third parties for marketing purposes.
- Inference requests are processed via secure API connections with minimum data transmission.
6. Payment
- Fees are billed monthly in advance as specified in your service agreement.
- Payment is due within 14 days of invoice.
- All fees are quoted in Hong Kong Dollars (HKD) unless otherwise specified.
- We reserve the right to adjust pricing with 30 days' written notice.
7. Termination
- Either party may terminate the service agreement with 30 days' written notice.
- Upon termination, we will delete or return your configuration data within 30 days.
- Your business data remains on your infrastructure and is unaffected by termination.
- Outstanding fees for the current billing period remain payable.
8. Limitation of liability
Agent88 provides Services on a best-efforts basis. To the maximum extent permitted by law:
- We are not liable for decisions made based on your assistant's output.
- We are not liable for service interruptions caused by third-party providers, infrastructure failures outside our control, or force majeure events.
- Our total liability for any claim arising from the Services is limited to the fees paid by you in the 3 months preceding the claim.
This does not exclude or limit liability that cannot be excluded under Hong Kong law.
9. Intellectual property
- Agent88 retains ownership of its service platform, configurations, and proprietary systems.
- You retain ownership of your business data and any content generated by your assistant using your data.
- Neither party acquires rights in the other party's intellectual property except as expressly stated.
10. Changes to these terms
We may update these terms from time to time. Material changes will be communicated to active clients at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
11. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
